A federal judge recently issued a temporary restraining order to bar a former Panera’s executive from working at Papa John’s. The judge determined that Panera is likely to prevail on its complaint, which accuses its former vice-president of violating his non-competition agreement by accepting a new job as the Chief Information Officer of Papa John’s. The former employee argued that his non-competition agreement is unenforceable because Papa John’s and Panera’s are not competitors but the judge held that the agreement is enforceable because, among other reasons, it specifically cites Papa John’s as a competing business.
